Terms of Service — ToastRank

Welcome to ToastRank. These Terms of Service (“Terms”) govern your access to and use of the ToastRank website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

If you do not agree, please do not use ToastRank.

1. About ToastRank

ToastRank is a community platform where members can upload speeches, watch and evaluate others’ speeches, leave timestamped comments, submit judging ballots, earn and spend Toastokens, and view rankings.

ToastRank is not affiliated with, endorsed by, or sponsored by Toastmasters International. We are inspired by the Toastmasters experience, but we are an independent service. Toastmasters® is a registered trademark of Toastmasters International.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have permission from a parent or guardian. You must provide accurate registration information and keep your account details up to date.

3. Your account

You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us promptly if you believe your account has been compromised.

You may update your profile, change your password, or delete your account from your account settings. Deleting your account is permanent and removes your access to the Service, subject to data we are required or permitted to retain (see Section 10).

4. User content

“User content” includes speeches you upload (video files or links), comments, replies, reactions, judging scores, profile information, profile photos, and any other material you submit to the Service.

You retain ownership of your user content. By posting it on ToastRank, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute your content solely to operate and improve the Service — including showing your speeches to other members, displaying comments and scores, and featuring content in rankings or promotional materials for ToastRank.

You represent that:

You own or have the necessary rights to upload and share your content;
Your speeches are your original work, or you have confirmed originality when prompted at upload;
Your content does not infringe anyone’s copyright, privacy, or other rights;
Your content is not unlawful, defamatory, harassing, hateful, or otherwise objectionable.

5. Acceptable use

You agree not to:

Upload content you do not have rights to share, including contest speeches where rules prohibit publication;
Impersonate another person or misrepresent your Toastmasters experience or credentials;
Manipulate scores, rankings, or Toastoken balances through fraud or automation;
Harass, bully, or abuse other members in comments or elsewhere on the Service;
Attempt to access accounts, data, or admin areas without authorisation;
Interfere with or disrupt the Service, including through excessive automated requests;
Use the Service for any unlawful purpose.

We may remove content, suspend accounts, or take other action we consider appropriate if you breach these Terms or if content is reported to us.

6. Judging, comments, and moderation

Members may score speeches using contest-style ballots, leave timestamped comments, react during playback, and flag comments for review. Judging and comments reflect individual opinions and do not constitute official Toastmasters evaluations.

You may not judge your own speeches. We use judge experience levels to weight scores in rankings. Administrators may review flagged comments, outlier scores, and other reports, and may remove content or resolve reports at their discretion.

7. Toastokens

Toastokens are a virtual in-service currency. You may earn Toastokens (for example, by judging speeches) and spend them (for example, to post a speech). Toastokens have no cash value, cannot be exchanged for money, and are not transferable outside the Service. We may adjust Toastoken balances, rewards, or costs at any time.

8. Third-party services

The Service may integrate with or link to third parties, including:

YouTube — for hosting or embedding some speech videos;
Bunny Stream — for hosting and delivering uploaded video files;
Google Analytics — for understanding how the Service is used.

Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for third-party services.

9. Intellectual property

The ToastRank name, logo, site design, software, and other materials we provide (excluding user content) are owned by us or our licensors. You may not copy, modify, or distribute them without our permission.

10. Privacy and data

We collect and process information you provide when you register and use the Service, including your name, email, club and district details, profile photo, speech uploads, comments, scores, activity, and similar data. This information is stored on our servers so the Service can function across devices and sessions.

Our use of cookies and similar technologies is described in our Cookies Policy. We will publish a separate Privacy Policy with fuller detail before or as we go live.

11. Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee uninterrupted access, accurate rankings, or that feedback from other members will meet your expectations. Rankings and scores are community-generated and for entertainment and learning purposes.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, ToastRank and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) £10.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including licences granted, disclaimers, and limitations of liability) will continue to apply.

14. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may also be communicated through the Service. Continued use after changes take effect constitutes acceptance.

15. General

These Terms constitute the entire agreement between you and ToastRank regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision.

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring claims elsewhere.
